A trial has begun in the case of a former US Marine who is accused of putting a homeless man in a fatal chokehold on a New York subway train. Daniel Penny, 25, has pleaded not guilty to charges of second-degree manslaughter and negligent homicide.

A U.S. Marine Corps veteran charged with manslaughter for placing a man in a deadly chokehold aboard a New York City subway train last year will soon have his day in court.

Jury selection began Monday in Manhattan in the case against Daniel Penny, the former Marine accused of recklessly choking a homeless man to death on a crowded subway train. Penny, 24, arrived on the first day of his trial as dozens of placard-bearing protesters gathered outside the lower Manhattan courthouse,

Jury selection has begun in the criminal trial of the U.S. Marine Corps veteran who placed a man in a deadly chokehold aboard a New York City subway train last year.

Penny could face up to 15 years in state prison if convicted of the top count. The trial is expected to last until around Christmas.

The Daniel Penny trial officially got underway Monday as the court looked to select jurors to oversee the infamous 2023 train ride chokehold death of Jordan Neely. Penny is accused of taking Neely’s life during an incident on board a Lower Manhattan F train in May 2023.
